A teenager is being sued by an insurance firm because he failed to stop his younger brother from running out into the path a car.
In a move that could set a legal precedent by making children responsible for each other, Norwich Union issued the writ against Gareth Minchin, from Southampton, in a bid to offset damages for its client who admits liability for driving the car. It is believed to be the first time an insurance company has attempted to make a juvenile pay for an accident he was not directly involved in.
Gareth's brother, Matthew, now needs constant care and the Minchin family have branded Norwich Union's actions as "ridiculous".
